| Hello , Ok. Everyone knows about DUIs correct? Driving under the influence. Illegal. Blah. First thing you think about is driving under the influence of alcohol... but ever heard of getting pulled over and cited for driving under the influence of fatigue? Apparently that's what my friend was charged with... it went under the dui category... I thought that was kind of interesting... has anyone else ever heard of this? Regards |

| I have never heard of such a thing, did they test your friend for alcohol prior to determining this is what they were stopping them for, sounds like they were looking for something, if you ask me sounds kinds crazy. |

| Hi Preston. This does sound pretty strange. Did they notice your friend nodding off while driving or something? I wonder how they can prove a person is driving under the influence of fatigue? I'd love to hear more about this when you know more. |

| Given that they don't generally pull people over just for fun (unless that end of the month quote is due LOL) I guess he was weaving, crossing the centre line or something. Given that a dangerous driving charge has much stiffer penalties I would suggest he just take the DUI and be happy with it. |

| I have been in such situation , i work so hard and late that when i get back i get tired and it s like driving while drinking , i cant even see on road |

| I can understand the need for dealing with a person who is in this state, however I cannot understand the DUI charge. This really should have been a negligence charge, not DUI. |

| I completely agree, and therein lies the negligence. No matter how hard it is to make the decision whether or not you are fit to drive, that IS your decision. No one else will make it for you unless it is plainly clear that you are unfit and they happen to see that. So if you make that decision incorrectly, you are neglecting the safety of others. |

| I know in New Jersey people get charged with this pretty often. It was made very popular after a string of truck accidents when overtired drivers killed a few people after crashing from a lack of sleep. |
